This Privacy Policy explains how Build Nexus LLC ("Build Nexus," "we," "us," or "our") collects, uses, discloses, and protects information in connection with buildnexusnyc.com and the related services we provide (collectively, the "Services"). We provide permit expediting services for architects, engineers, and related professionals.

Please read this Policy carefully. By accessing or using our Services, creating an account, or subscribing to our updates, you acknowledge that you have read and understood this Policy.

Note on scope: Our Services are directed to users in the United States. They are not directed to individuals in the European Union, the United Kingdom, or other jurisdictions whose data protection laws may differ. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

1. Information We Collect

We collect information in three ways: information you provide to us directly, information we collect automatically when you use the Services, and information we receive from third parties.

a. Information you provide to us

  • Account information. When you create an account, including through a third-party social login (see below), we collect information such as your name, email address, and account credentials.
  • Social login information. If you choose to register or log in using Google or Facebook (Meta), those providers share certain profile information with us, which may include your name, email address, profile photo, and a unique account identifier associated with that provider. The information we receive depends on your settings and the permissions you grant. We do not receive your password for those accounts.
  • Subscription and contact information. When you sign up to subscribe to our data and updates, we collect your contact details, including your email address and telephone number, and your subscription and communication preferences.
  • Professional information. Because our Services are used by professionals, we may collect information such as your profession, firm or company name, and project-related details you provide.
  • Communications. If you contact us or we contact you, we keep records of those communications, including the content of messages, emails, and call notes.
  • Payment information (if and when applicable). We do not currently sell products or paid subscriptions through the Services. If we introduce paid subscriptions or other paid features in the future, payment card and billing information will be collected and processed by a third-party payment processor; we do not store full payment card numbers on our systems.

b. Information we collect automatically

When you visit or interact with the Services, we and our service providers automatically collect certain information using cookies, pixels, and similar technologies (see Section 3):

  • Device and connection information, such as IP address, browser type, operating system, device identifiers, and general (city/region-level) location derived from your IP address.
  • Usage information, such as the pages you view, links you click, the dates and times of your visits, referring and exit pages, and how you interact with our content and advertisements.
  • Cookie and tracking data, including data collected through the Meta Pixel and Google advertising and analytics technologies.

c. Information we receive from third parties

  • Social login providers (Google, Facebook/Meta), as described above.
  • Advertising and analytics partners, who may provide us with information about how users interact with our ads and the Services, and may help us measure and target advertising.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, operate, and maintain the Services, including creating and managing your account.
  • To deliver the data, updates, and notifications you subscribe to, by email and by telephone (including text/SMS messages and calls), consistent with your preferences and applicable law.
  • To communicate with you about your account, respond to your inquiries, and send administrative or service-related messages.
  • To market and advertise our Services, including delivering, measuring, and optimizing advertising to people who visit our website or log in, through platforms such as Google and Meta (see Sections 3 and 5).
  • To analyze and improve the Services, understand usage trends, and develop new features.
  • To detect, prevent, and address fraud, security incidents, abuse, and other harmful or unlawful activity.
  • To comply with legal obligations, enforce our terms, and protect our rights and the rights, safety, and property of others.

3. Cookies and Tracking Technologies

We and our partners use cookies, web beacons, pixels (including the Meta Pixel), software development kits, and similar technologies to operate and secure the Services, remember your preferences, analyze traffic, and deliver and measure advertising.

These technologies fall into general categories:

  • Strictly necessary technologies required for the Services to function.
  • Analytics technologies that help us understand how the Services are used (for example, Google analytics tools).
  • Advertising technologies that help us and our partners deliver and measure relevant advertising across other websites and platforms (for example, the Meta Pixel and Google advertising tools). These technologies may collect information such as your device identifiers, IP address, and browsing activity, and may share that information with Google and Meta.

Your choices. You can usually set your browser to refuse or delete cookies, though some features of the Services may not function properly without them. Where required, we provide a cookie banner or preference tool that lets you manage non-essential cookies. We also honor recognized opt-out preference signals, including the Global Privacy Control (GPC), as described in Section 5.


4. How We Disclose Information

We disclose information in the following circumstances:

  • Service providers. We share information with vendors who perform services for us, such as hosting, data storage, analytics, email and SMS delivery, customer support, and payment processing. These providers are permitted to use the information only to perform services on our behalf.
  • Advertising partners. We share certain information — such as identifiers and online activity — with advertising platforms, including Google and Meta, so that we can advertise our Services and measure the effectiveness of that advertising. Depending on your state, this disclosure may be considered a "sale" or "sharing" of personal information under applicable privacy laws, even though we do not receive money in exchange for it. See Section 5 for your opt-out rights.
  • Social login providers. When you use Google or Facebook to log in, your interactions are also subject to those providers' own terms and privacy policies.
  • Legal and safety. We may disclose information if we believe doing so is required by law, regulation, legal process, or governmental request, or where necessary to protect the rights, property, or safety of Build Nexus LLC, our users, or others.
  • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.

We do not disclose your personal information to third parties for their own independent marketing purposes without your consent.


5. Advertising and Your Opt-Out Choices

We use Google and Meta (Facebook/Instagram) to advertise our Services to people who visit our website or log in, including through retargeting. As explained above, the use of the Meta Pixel and similar advertising technologies may constitute a "sale" or "sharing" of personal information under certain state privacy laws.

You have the following choices:

  • Do Not Sell or Share My Personal Information. You can opt out of the "sale" or "sharing" of your personal information for cross-context behavioral advertising by submitting your request here.
  • Global Privacy Control (GPC). We treat a recognized opt-out preference signal, such as GPC, that we detect from your browser or device as a valid request to opt out of the sale/sharing of personal information for that browser or device.
  • Platform-level controls. You can manage ad personalization directly through:
    • Google Ads Settings at myadcenter.google.com (or your Google account ad settings); and
    • Meta ad preferences within your Facebook/Instagram account settings.
  • Industry opt-out tools. You can opt out of many participating companies' interest-based advertising through the Digital Advertising Alliance and the Network Advertising Initiative.

Opting out does not mean you will stop seeing ads; it means the ads you see may be less relevant to you.


6. Email and Text Message (SMS) Communications

If you subscribe to our updates, you may receive communications from us by email and, where you have provided your phone number and the necessary consent, by telephone, including text (SMS) messages.

  • Consent. By providing your phone number and opting in, you consent to receive calls and text messages from us or on our behalf, which may include messages sent using automated technology, at the number provided. Consent to receive marketing texts or calls is not a condition of purchasing or using any Services.
  • Message frequency and rates. Message frequency varies. Message and data rates may apply.
  • Opting out. You can opt out of marketing emails at any time by using the "unsubscribe" link in any such email. You can opt out of text messages at any time by replying STOP to any message; reply HELP for help. You may continue to receive non-promotional, transactional, or service-related messages as permitted by law.

7. Your Privacy Rights

Rights available to all users. Regardless of where you live, you may contact us to:

  • Access the personal information we hold about you;
  • Request that we correct inaccurate personal information;
  • Request that we delete your personal information; and
  • Opt out of marketing communications and of the sale/sharing of your personal information for advertising.

We will not discriminate against you for exercising any of these rights.

a. California residents (CCPA/CPRA)

If you are a California resident, you have certain rights regarding your personal information, subject to exceptions in the California Consumer Privacy Act, as amended:

  • The right to know what personal information we collect, use, disclose, and "sell" or "share";
  • The right to access and obtain a copy of your personal information;
  • The right to delete personal information we have collected from you;
  • The right to correct inaccurate personal information;
  • The right to opt out of the "sale" or "sharing" of your personal information; and
  • The right to non-discrimination for exercising your rights.

Categories of personal information. In the preceding 12 months, we have collected the following categories of personal information, and disclosed and/or "shared" them as indicated:

We do not knowingly collect or process sensitive personal information for purposes that require a separate right to limit its use, and we do not "sell" or "share" the personal information of individuals we know to be under 16 years of age.

How to exercise your rights. You (or an authorized agent acting on your behalf) may submit a request by contacting us as described in Section 11. We will verify your request, which may require you to provide information sufficient to confirm your identity. We will respond within the timeframes required by law.

b. Residents of other states

Several other U.S. states have enacted comprehensive privacy laws (including Virginia, Colorado, Connecticut, Texas, and others). If you are a resident of a state that grants such rights and those rights apply to you, you may have rights similar to those above — including to access, correct, delete, and obtain a portable copy of your personal information, and to opt out of targeted advertising and the sale of personal information. To exercise any available rights, please contact us as described in Section 11.


8. Data Retention

We retain personal information for as long as necessary to provide the Services, maintain your account and subscriptions, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take steps to delete, de-identify, or securely store it.


9. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, consistent with applicable law, including New York's Stop Hacks and Improve Electronic Data Security (SHIELD) Act. However, no method of transmission or storage is completely secure, and we cannot guarantee the absolute security of your information. In the event of a data breach affecting your information, we will provide notice as required by applicable law.


10. Children's Privacy

The Services are intended for professional use and are not directed to children under 13 (or under 16 where applicable). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without appropriate consent, we will take steps to delete it. If you believe a child has provided us with personal information, please contact us.


11. Third-Party Websites and Services

The Services may contain links to or integrations with third-party websites and services that we do not control, including Google and Meta. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third party before providing them with your information.


12. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate or required by law, provide additional notice. Your continued use of the Services after an updated Policy becomes effective constitutes your acceptance of the changes.
